Terms and Conditions

By accessing or using Data Pilot you agree to these Terms and Conditions. If you do not agree, do not use the service.

1. Who we are and how this contract works

These Terms and Conditions govern your use of the Data Pilot website, desktop application, and related services provided by the operator of getdatapilot.com, referred to as Data Pilot, we, or us. When you create an account, you accept these Terms on behalf of yourself and, if applicable, on behalf of the company or organization you represent. If you accept on behalf of a company, you confirm that you have authority to bind that company. We may update these Terms from time to time by posting a revised version at this URL. Continued use after changes means you accept the new version.

2. Eligibility and account administration

  • You must be able to form a binding contract and be at least 18 years old. Data Pilot is intended for business users.
  • The person who registers first for a company becomes the company admin and can invite or remove users.
  • You are responsible for your account credentials and for all activity under your account.

3. Desktop license and seats

The desktop application is licensed, not sold. A company license includes a number of seats. Each seat is assigned to a named user and may be activated on a limited number of devices owned by that user. We may include a periodic online license check and a reasonable offline grace period. You shall not share license keys, bypass activation, or attempt to disable technical protections.

We grant you a limited, non exclusive, non transferable, revocable license to install and use the desktop application for your internal business purposes, subject to these Terms and any plan limits. We reserve all rights not expressly granted.

4. Service description and data handling

  • Data Pilot helps you generate and maintain database documentation and ERD. It scans schema metadata such as tables, columns, keys, relationships, and native comments. You can edit texts, add notes, and export Markdown or PDF.
  • Documentation content and related metadata may be stored on our servers for your account. This can include workspace names, schema summaries, table and column descriptions, ERD diagram structure, and saved settings needed to keep your documentation in sync across devices.
  • By default query results and data rows remain in your database. You are responsible for data you access or process with Data Pilot and for complying with your own data policies and laws.
  • AI features produce drafts based on schema metadata. We do not use customer data rows for AI suggestions unless you choose to include sample data in a prompt. Outputs are assistive and must be reviewed by a human before use.
  • If you connect to third party services or databases you authorize us to act on your behalf to the limited extent needed to provide the service.
  • If you use AI features with your own key the processing is performed by the model provider under their terms. If you use a managed AI option we will process prompts as your processor according to our Privacy Policy and, where applicable, a Data Processing Addendum available on request.

5. Acceptable use

  • Do not use the service in violation of laws, including data protection and export control rules.
  • Do not upload illegal content, malicious code, or attempt to disrupt or probe our infrastructure without written permission.
  • Do not use the service to build a competing product that copies user interface or features in a confusing way.
  • Respect rate limits and plan limits. We may throttle or suspend accounts that negatively affect stability or security.

6. Privacy and data protection

We describe how we collect and process personal data in our Privacy Policy. We act as controller for account data such as user profile, billing contact, and service telemetry. For customer controlled content such as documentation texts, ERD structure, and connection metadata, we act as processor and process data only to provide and secure the service, subject to your instructions and the agreement.

  • GDPR: if you are in the EU or EEA, you have rights over your personal data. You can contact us to exercise access, rectification, or deletion where applicable.
  • Subprocessors: we may use third party providers such as hosting, email, payments, error tracking, and AI vendors. We keep an updated list in our Privacy Policy.
  • Security: we implement reasonable technical and organizational measures to protect data. No method is perfectly secure.

7. Intellectual property and feedback

All rights in the service, software, and content are owned by us or our licensors. You keep your rights in your data and in your documentation content. If you choose to give feedback or suggestions, you grant us a perpetual and royalty free right to use that feedback to improve the service with no obligation to you.

8. Third party services

The service may link or interoperate with third party services, such as database providers or AI model providers. We are not responsible for those services. Your use of them is governed by their terms and privacy policies.

9. Pricing, billing, and taxes

Paid plans require a valid payment method. Payments are processed by a third party payment processor such as Stripe. Prices are shown before VAT unless stated otherwise. Where required, VAT or other taxes will be charged and remitted according to applicable law.

  • Subscriptions renew automatically each billing period until canceled. You can cancel at any time from the account portal and your plan will remain active until the end of the paid period.
  • We may change prices or features with reasonable notice posted on the site or sent to the account email.
  • Refunds are evaluated case by case unless mandatory law provides otherwise.

10. Trials and promotions

If you receive a free or trial plan, we may limit features or duration. At the end of the trial your plan may revert to Free unless you upgrade. We reserve the right to withdraw promotions at any time.

11. Beta features

We may offer early features as beta. Beta features are provided as is, may change without notice, and may have reduced support or availability.

12. Disclaimers

The service is provided on an as is and as available basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the service will be error free, uninterrupted, or that data will always be available. AI features generate drafts that can contain errors and must be reviewed by a human before use.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business. Our total liability for all claims in any twelve month period will not exceed the amounts you paid for the service in that period, or fifty euros if you use the Free plan. These limits apply regardless of the legal theory and even if a remedy fails its essential purpose.

14. Indemnification

You agree to defend, indemnify, and hold harmless Data Pilot and our affiliates from claims, damages, and costs arising from your unlawful use of the service, your data, or your breach of these Terms.

15. Suspension and termination

We may suspend or terminate access if you breach these Terms or fail to pay. You may terminate at any time by canceling your plan and uninstalling the application. On termination your right to use the service ends, but sections that by nature survive will continue, including intellectual property, fees owed, disclaimers, limitations, indemnification, and governing law.

16. Export control and sanctions

You must comply with export control and sanctions laws that apply to the service. You confirm that you are not located in an embargoed country and are not on a restricted party list.

17. Governing law and venue

These Terms are governed by the laws of Italy, without regard to conflict of law rules. Any disputes will be brought exclusively in the courts located in Rimini, Italy. If you are a consumer and mandatory law provides a different venue, that venue will apply.

18. Changes to the service

We may change or discontinue features over time. Items labeled as roadmap or coming soon are forward looking statements and are not a promise to deliver on a specific date. For material changes that negatively affect paid plans we will provide reasonable notice.

19. Miscellaneous

  • Severability: if a provision is unenforceable, the rest remains in effect.
  • No waiver: failure to enforce a provision is not a waiver.
  • Assignment: you may not assign this agreement without our consent. We may assign in connection with a merger or sale.
  • Notices: we may send notices to the email associated with your account. You may send legal notices to the address on our contact page.
  • Entire agreement: these Terms, the Privacy Policy, and any order or plan details form the entire agreement between you and us for the service.
  • Open source: the app may include components under open source licenses. Those licenses govern the components they cover.

21. Data export and deletion

You can export documentation from within the product. When you close your account you may request deletion of personal data and customer controlled content that we store as processor, subject to legal retention duties. Deletion will remove active copies within a reasonable time and will follow our standard backup expiration cycle.

22. Data Processing Addendum

If you are in the EU or EEA or otherwise require a written processor agreement, a Data Processing Addendum that includes the required Article 28 terms and standard contractual clauses for international transfers is available on request. Contact us to initiate the process.
